NY Gov Cuomo Latest Gun Grab

Governor Cuomo is at it again.

Invoking emergency powers given him during the pandemic, the governor has declared a "gun violence disaster emergency" as he seeks, in our opinion, to remedy a reputation hit by his dreadful mishandling of COVID (esp with regard to nursing homes) and his alleged misconduct with women.

However, Cuomo just signed a bill allowing for New York to try and sue gun manufacturers over harm caused by their products. This will likely conflict with the federal Protection of Lawful Commerce in Arms Act of 2005, which gave gun manufacturers immunity from lawsuits related to the criminal misuse of their products.

Body armor bill is stricken

Back in January, we reported the New York State Senate introducing Assembly Bill 352, which seeks to criminalize “the unlawful possession or purchase of a body vest.”

Looking at the bill's status, it appears that the enacting language was stricken.  According to this document by the NY City Bar Association, means the bill is dead. So that's good news.

Enacting clause stricken When the main sponsor of a bill removes their support for the bill and the title has been deleted. Bill is considered dead unless another legislator decides to sponsor the bill, at which point it will need to be reintroduced and assigned a new bill number.

Hopefully, it will remain dead.

Law abiding citizens in The Empire State are already burdened enough by onerous laws, none of which criminals will obey.
