LA County Sheriff will not enforce new mask mandate

With COVID cases apparently on the rise, the Los Angeles County Department of Public Health will once again require people to wear masks indoors, even if they’ve been vaccinated against the disease.

But the LA County Sheriff, Alex Villanueva, indicated he will not have his deputies enforce the order, saying it’s “not backed by science” and contradicts guidelines from the CDC.

How can he do this?

In a blog post from July, 2020, we talk about the origins of authority. Within that, we covered the Doctrine of the Lesser Magistrate is a legal concept explaining how and when a lower-level government official has both the right and duty to resist a ‘greater ruler’ who seeks to overreach their authority.

After almost 18 months of governments at all levels dictating how people must comply, other agencies are starting to push back. While this happened more in ‘red state’ areas, which one would expect, to see this starting to play out in one of the bluest states is a good thing.
